Terms and Conditions for Easy Memory Item
Effective date: September 29, 2026
These Terms and Conditions (the Terms) govern your access to and use of Easy Memory Item (EMI), including its iOS and Android applications, websites, connected services, and restricted administration functions (together, the Services).
The Services are provided by Easy Memory Item UG (haftungsbeschränkt), Stettiner Straße 28, 57518 Betzdorf, Germany, represented by its managing director Tino Janke (EMI, we, us, or our).
By choosing an aircraft during Onboarding, you agree to these Terms and acknowledge our Privacy Policy. If you are not legally able to enter into this agreement independently, you may use EMI only with the authorization of your parent or legal guardian.
1. The Services
EMI provides tools for learning, reviewing, and practising aircraft procedures and limitations, as well as tools for working through checklists. Depending on your access tier and the available content, the Services may include:
- an Aircraft Catalogue with selectable Aircraft;
- Learn and Quiz tools;
- supplemental checklist tools under Fly;
- offline access to previously downloaded content;
- synchronization of Account-owned learning information between installations; and
- restricted tools through which authorized administrators maintain EMI content.
Some functions require an internet connection, including initial Account setup, Sign-in, acquiring content, synchronization, purchases, recovery, and administration. Connectivity, device compatibility, battery power, and any data or roaming charges are your responsibility.
2. Aviation safety and content
EMI is a training, reference, and supplemental operational aid. It is not certified avionics and is not a replacement for current, approved aircraft documentation, operating manuals, quick reference handbooks, checklists, standard operating procedures, required training, instructions from an operator or authority, or your own professional judgment.
Before relying on EMI in connection with an aircraft operation, you must verify that the selected Aircraft and its content are appropriate, complete, accurate, and current for the aircraft, configuration, operator, and operation concerned. Current approved documentation and applicable instructions always control if they differ from EMI.
Content may be unavailable, incomplete, contain errors, or become outdated. A currency warning indicates only that content has not synchronized recently; it does not confirm that content is current. Synchronization and content updates can occur at different times on different installations.
References to manufacturers, aircraft, airlines, flight schools, clubs, and other operators identify the context of content. Unless EMI expressly states otherwise, they do not imply that the named person or organization supplied, sponsors, endorses, approves, or continuously maintains that content.
You remain responsible for deciding whether and how to use EMI and for complying with all laws, approvals, qualifications, procedures, and safety duties applicable to you and the operation.
3. Accounts, local data, and synchronization
EMI may silently provision an anonymous Account when an installation first reaches the internet. An anonymous Account is ordinarily reachable only from the installation that holds its session. Sign-in with Apple or Google can make an Account recoverable and reachable from other installations.
You are responsible for protecting your device, store account, external identities, and access to EMI. You must not let another person use your Account in a way that misrepresents their identity, qualifications, authority, or learning record.
Not all information synchronizes:
- Account-owned learning information, including Quiz Sessions and results, may synchronize between installations using the same Account.
- checklist running state, including Check Statuses and Condition Statuses, remains on the installation and does not synchronize to another installation.
- other installation-local settings and selections may also remain only on that installation.
Installation-local information may be lost through application removal, operating-system storage removal, device loss or failure, or destructive re-enrollment. We do not promise that locally stored information can be recovered.
Sign-out ends the linked Account Session on that installation, removes its synchronized local Account data, and starts the installation with a fresh anonymous Account. The linked Account and its synchronized server data remain available through Sign-in.
Account Deletion immediately and irreversibly removes the Account and Account-owned server data. It removes synchronized Account data from the initiating installation and dissolves other Account Sessions. Another installation removes its synchronized Account data when it next connects; installation-local operational state may remain because it is not Account-owned. We cannot remotely remove data from a device that never reconnects.
Our processing of personal data is described in our Privacy Policy.
4. EMI Pro and store purchases
EMI may provide a curated starter selection without charge. An active EMI Pro subscription unlocks the content and learning tools described on the purchase screen.
Subscriptions are purchased and billed through the Apple App Store or Google Play. The applicable store purchase screen and store terms specify the current price, billing period, taxes, trial or promotional conditions, automatic renewal, and payment terms. A subscription renews automatically until it is cancelled through the store account that purchased it.
Cancellation and refund requests must be made through the applicable store and are governed by its rules and mandatory law. Cancelling ordinarily stops renewal but does not remove access already paid for before the end of the current billing period.
A Purchase belongs to the Apple or Google store account that paid for it. Its EMI Pro entitlement may follow that store account to whichever EMI Account is active on the device. Restoring purchases can therefore move the entitlement between EMI Accounts. Account Deletion does not cancel a store subscription, and store billing may continue until you cancel it with Apple or Google.
5. Licence and intellectual property
Subject to these Terms, EMI grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to use the Services for lawful private or professional aviation purposes.
The Services, software, designs, databases, branding, and content are protected by intellectual-property laws. They belong to EMI or the respective licensors. No ownership rights are transferred to you, and all rights not expressly granted are reserved.
Except where applicable law expressly permits it, you must not:
- copy, reproduce, republish, sell, rent, sublicense, redistribute, or commercially exploit the Services or their content;
- scrape, systematically extract, or build a substitute database from EMI content;
- modify, translate, reverse engineer, decompile, disassemble, or create derivative versions of the software;
- remove ownership, attribution, or rights notices;
- bypass access controls, subscription restrictions, or security measures; or
- use EMI names, logos, or content in a way that suggests an unauthorized affiliation, approval, or endorsement.
Open-source components included in the software remain governed by their respective licences. Those licences prevail for the components to which they apply.
6. Acceptable use and administration
You must use the Services lawfully and must not:
- compromise, probe, overload, disrupt, or interfere with the Services or another person’s use of them;
- introduce malware or attempt to obtain unauthorized access to Accounts, data, systems, or administration functions;
- use automated means to access the Services except where EMI has expressly authorized them;
- infringe intellectual-property, privacy, confidentiality, or other rights;
- falsify your identity, authority, qualifications, learning activity, or relationship with an operator; or
- use the Services to encourage unlawful or unsafe conduct.
Restricted administration functions may be used only by people whom EMI has authorized for those functions. Access may also be governed by employment, contractor, confidentiality, content-contribution, or other separate terms. Access to the Services does not give you any right to use administration functions or publish content.
7. Third-party services
The Services interact with third parties, including Apple and Google for application distribution, identity, and purchases. Your relationship with those third parties is governed by their applicable terms. EMI is not responsible for a third party’s services, accounts, availability, decisions, or processing outside EMI’s control.
Links or references to third-party services do not imply endorsement. If third-party terms conflict with these Terms, each set of terms governs the relationship and subject matter to which it applies, subject to mandatory law.
8. Availability, updates, and changes
We aim to keep the Services secure and useful, but we do not promise uninterrupted or error-free availability, synchronization, compatibility with every device or operating-system version, or permanent availability of particular content or features.
We may update the Services and require a supported application version for network operations. An unsupported version may lose access to synchronization and other online functions while existing installation-local private use remains available where technically possible.
We may change the Services for security, legal compliance, compatibility, maintenance, or improvement. Where mandatory law requires notice, continued access to an unchanged version, a termination right, or another remedy, we will provide it. Changes to these Terms will be handled according to their nature and applicable law; material changes will not be treated as accepted merely because you continue using EMI.
9. Suspension and termination
You may stop using the Services at any time. You may delete your Account through the application. Removing the application alone does not delete your Account or cancel an active store subscription.
We may restrict or suspend access where reasonably necessary to address unlawful use, a security threat, unauthorized administration access, infringement, or a material breach of these Terms. Where appropriate, we will provide notice and a reasonable opportunity to remedy the issue.
We may discontinue all or part of the Services with reasonable advance notice where practicable. Downloaded free content and installation-local operational state may remain usable where technically and legally possible. Subscription rights, refunds, and other remedies remain subject to the applicable store terms and mandatory law.
When this agreement ends, the licence in section 5 ends except to the extent these Terms or mandatory law expressly preserve a right. Provisions that by their nature should continue—including intellectual-property, liability, and governing-law provisions—remain effective.
10. Statutory rights and liability
Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited, including mandatory consumer rights.
EMI is liable without limitation for intent and gross negligence; injury to life, body, or health; an expressly assumed guarantee; fraudulent concealment; and liability under the German Product Liability Act or other mandatory law.
For slight negligence, EMI is liable only for breach of an essential contractual obligation whose fulfilment is necessary for proper performance of the agreement and on which you may regularly rely. In that case, liability is limited to the loss that was typical and reasonably foreseeable when the agreement was formed.
Subject to those rules and mandatory statutory rights, EMI does not warrant that aviation content is current, complete, error-free, or suitable as the controlling documentation for a particular aircraft or operation. The same limitations apply to uninterrupted availability, synchronization, and recovery of installation-local information.
11. Governing law
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of the country in which you ordinarily reside. Any court with jurisdiction under mandatory law remains available to you.
12. General provisions
If a provision of these Terms is invalid or unenforceable, the remaining provisions continue to apply. The applicable statutory rule replaces the invalid or unenforceable provision.
Our failure to enforce a provision immediately does not waive it. You may not transfer this agreement without our consent. We may transfer it as part of a merger, restructuring, or transfer of the Services, provided this does not reduce your mandatory rights.
These Terms and any additional terms expressly applicable to a feature form the agreement concerning your use of the Services. Individually agreed terms prevail where required by law.
